1. How Flower Foundry Works
• FlowerFoundry is an online marketplace / platform.
• Independent florists (“Vendors”) list, prepare, and deliver the products.
• When you place an order, you are buying directly from the Vendor, not Flower Foundry.
• Flower Foundry handles the website, payments, and support, but does not make or deliver the flowers.
2. Using the Website Registration and Acceptance of Terms
• You must be 18 or older.
• You must provide accurate information when placing an order.
• Keep your login details safe. You’re responsible for your account.
• By registering as a customer on this platform, you acknowledge that these Terms and Conditions constitute a legally binding agreement, and you agree to be bound by them.
• Flower Foundry reserves the right, in its sole discretion, to change, modify, add to, or remove from portions or the whole of these Terms and Conditions from time to time.
• It is your responsibility to review these Terms and Conditions periodically.
• Your continued use of the platform following any changes will be deemed acceptance of, and agreement to be bound by, the updated Terms and Conditions.
• If you breach any of these Terms and Conditions, we may suspend or cancel your account and/or your access to the platform.
3. Consent to Electronic Communication
• You consent to receiving electronic communications from Flower Foundry by email, SMS and/or WhatsApp via the contact details submitted.
• Communication includes electronic invoices, order confirmations, platform notifications, and marketing‑related communications.
• You may opt out of the marketing communications at any time.
4. Placing an Order
• Choose a product, add it to your cart, and complete payment.
• Your order is confirmed once payment is received and you get a confirmation email.
• If an order is received over a weekend or on a public holiday, it will only be processed on the next business day.
5. Product Images & Substitutions
• Flowers are natural and seasonal, so arrangements may vary slightly.
• Vendors may substitute flowers of equal or higher value if something is unavailable.
• Images on the website are for illustration purposes and may vary on receipt.
6. Pricing & Payment
• All prices are in South African Rand.
• Delivery fees are shown at checkout.
• Payment must be made using the methods provided on the website.
7. Delivery
• Delivery is done by the Vendor or their courier.
• Delivery times are estimates and may be affected by traffic, weather, or busy seasons.
• Delivery is complete when:
o the order is handed to the recipient, or
o someone at the delivery address accepts it
• If no one is available:
o the order may be left with a third party, or
o a re‑delivery fee may apply
• Neither Flower Foundry nor the Vendor / Florist will be responsible for delays or failures caused by events outside reasonable control, including weather conditions, traffic, accidents, strikes, or other unforeseen events.
8. Refunds, Returns & Complaints
• Flowers and plants are perishable products. If you are unhappy with your order, you must report the issue within 24 hours of delivery.
• Complaints
o You may raise a complaint if:
▫ the wrong product was delivered
▫ the product arrived damaged
▫ the quality of the product is not acceptable
o All complaints must:
▫ be reported within 24 hours of delivery
▫ include clear photographs of the product
▫ be sent directly to the supplying Vendor. Their contact details will appear on your invoice
o Due to the nature of flowers and the recipient’s responsibility to care for them once delivered, complaints submitted after this period will not be accepted.
• Refunds or Replacements
o Depending on the circumstances, the supplying Vendor may:
▫ offer a refund, or
▫ provide a replacement product
o Refunds or replacements are handled by the Vendor and are granted at the Vendor’s discretion.
• Because flowers are perishable goods, statutory return rights may not apply.
• The appearance and longevity of flowers depend on their natural characteristics and the care provided after delivery.
• Flowers should be placed in clean water daily and kept in temperatures not exceeding 23°C. With proper care, flowers should last approximately eight (8) days. Variations in lifespan due to environmental conditions or care after delivery do not constitute a defect.
9. What Flower Foundry Is Not Responsible For
• delivery delays
• incorrect delivery addresses
• variations in product appearance
• actions or mistakes by Vendors
10. Indemnity and Limitation of Liability
• Your use of the platform is at your own risk. The platform and all content are provided on an “as is” and “as available” basis.
• Flower Foundry will not be liable for any indirect, special, consequential, or punitive loss or damages, or any loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the platform or any products purchased from Vendors.
• Flower Foundry’s total liability to you for any claim arising out of or in connection with the platform or these Terms and Conditions will be limited to the total fees (if any) paid by you to Flower Foundry in the three (3) months immediately preceding the event giving rise to the claim.
• You indemnify and hold Flower Foundry harmless against any loss, damage, liability, claim, cost, or expense (including reasonable legal fees) arising from or in connection with your breach of these Terms and Conditions; your misuse of the platform; any unlawful act or omission by you; or any claim by a third party relating to your use of the platform.
• Nothing in these Terms and Conditions is intended to exclude or limit any rights or remedies you may have under applicable law, or to exclude or limit Flower Foundry’s liability where it would be unlawful to do so.
11. Privacy & POPIA
• By accessing or using the Flower Foundry website, you agree to these Terms and consent to the processing of your personal information as set out below.
• Your personal information is processed in accordance with applicable data protection laws, including the Protection of Personal Information Act (POPIA).
• Your information is shared with the Vendor only to the extent necessary to fulfil and deliver your order.
• Flower Foundry uses reasonable technical and organisational security measures to protect your personal information against loss, misuse, or unauthorised access.
12. Intellectual Property
• All website content belongs to Flower Foundry, except for images and descriptions uploaded by Vendors.
• The reproduction or use thereof without written consent is prohibited.
